Privacy Policy
Introduction
We are committed to protecting your personal data and respecting your privacy. This Privacy Policy explains how we collect, use, and protect your personal data when you use our services or interact with our website.
Who We Are
The controller of your personal data is Pygen Business Solutions, trading as Devan Intelligence ("Devan", "we", "us"). Pygen Business Solutions is incorporated under the laws of the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number 94087490. You can contact us at roland@devan.ai.
Data We Collect
We may collect the following types of personal data:
- Contact Information: Name, email address, and any other information you provide through our forms.
- Usage Data: Information about how you use our website and services.
- Business and public source data: Professional and business information about individuals (such as name, role, employer, and public professional profiles) obtained from publicly available sources or third-party providers to support our research services.
Where we do not obtain personal data directly from you, we collect it from publicly available sources (such as corporate websites and public professional profiles) and from business information providers. We use this information to provide research and analysis services to our clients, as explained in the "How We Use Your Data" and "Legal Grounds for Using Your Data" sections.
How We Use Your Data
We use your personal data to:
- Provide and Improve Services: To provide, operate, maintain, and improve our services.
- Communicate with You: To send you emails, including confirmation emails, newsletters, and responses to your inquiries.
- Legal Obligations: To comply with legal obligations and protect our legal rights.
Legal Grounds for Using Your Data
Depending on where you live and how you interact with us, we rely on one or more of the following legal grounds to use your personal data (for example under the GDPR in the EU):
- Performance of a contract or taking steps at your request: For example, where we respond to your inquiries, set up pilot projects, or provide our services to you.
- Legitimate interests: To operate, secure, and improve our website and services, to understand how they are used, and to communicate with business contacts about our services, provided that these interests are not overridden by your rights and interests.
- Consent: Where required by law, for example for certain types of marketing communications or the use of non-essential cookies and similar technologies.
- Legal obligations: Where we need to comply with laws and regulations, such as record-keeping or accounting rules.
Data Sharing and Disclosure
We do not sell your personal data.
We may share your personal data with trusted third-party service providers who process it on our behalf and in accordance with our instructions, for example providers of website hosting, cloud infrastructure, email delivery, and analytics services (including Mixpanel).
We may also disclose personal data where required by law, to competent authorities, or in connection with corporate transactions such as a merger, acquisition, or sale of assets.
Some browsers and tools send "Do Not Track" or similar signals (such as Global Privacy Control). Our website does not currently change its behaviour in response to these signals. As noted above, we do not sell your personal data, and if this changes we will update this Privacy Policy and provide any required opt-out options.
International Transfers
We use service providers in different countries to help us run and improve our services. Our analytics provider Mixpanel is configured to use EU data residency (eu.mixpanel.com), so analytics data is stored in the European Union.
In some cases, our providers may access or process personal data from outside your country or region (for example, for support or maintenance). When we transfer personal data internationally, we use safeguards that are recognised under applicable data protection laws, such as the European Commission's Standard Contractual Clauses where relevant.
Data Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.
Your Rights
Depending on where you live, you may have certain rights in relation to your personal data under applicable data protection laws (for example under the GDPR in the EU). These may include:
- Access: To request access to your personal data.
- Correction: To request correction of inaccurate or incomplete data.
- Deletion: To request deletion of your personal data.
- Objection: To object to the processing of your personal data.
- Restriction: To request that we restrict the processing of your personal data in certain circumstances.
- Data Portability: To request transfer of your personal data to another service provider.
You can exercise these rights by contacting us using the details set out in the "Contact Us" section below. We may need to verify your identity before responding to your request.
Where we rely on consent to process your personal data, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.
You also have the right to lodge a complaint with a data protection authority, in particular in the country or region where you live or work or where you consider that your rights have been infringed. If you have concerns about how we handle your personal data, we would appreciate the chance to address them first using the contact details below.
Data Retention
We will retain your personal data only as long as necessary to fulfill the purposes we collected it for, including legal, accounting, or reporting requirements.
Different types of personal data may be kept for different periods. For example, contact and lead information is typically kept for the duration of our relationship and for a limited period afterwards (for example up to three years), billing and accounting records may be kept for longer to comply with legal obligations (for example up to seven years), and analytics data is kept for a period appropriate for analysing usage trends before being deleted or anonymised.
